\u00a0(THE BUCKLEY AMENDMENT)\u00a0<\/span><\/p>\n

Notification of Rights under FERPA for Postsecondary Institutions: The Family Educational Rights and Privacy Act\u00a0(FERPA) affords students certain rights with respect to their education records. These rights include the following:\u00a0<\/span><\/p>\n

    \n
  1. The right to inspect and review the student\u2019s education records within 45 days of the day the College receives a\u00a0request for access. Students should submit to the registrar, dean, head of the academic department, or other appropriate\u00a0official, written requests that identify the record(s) they wish to inspect. The College official will make arrangements for\u00a0access and notify the student of the time and place where the records may be inspected. If the records are not maintained by\u00a0the College official to whom the request was submitted, that official shall advise the student of the correct official to whom\u00a0the request should be addressed.\u00a0\u00a0<\/span><\/li>\n
  2. The right to request the amendment of that part of the student\u2019s education records that the student believes is\u00a0inaccurate or misleading. Students may ask the College to amend a record that they believe is inaccurate or misleading. They\u00a0should write to the College official responsible for the record, clearly identify the part of the record they want changed and\u00a0specify why it is inaccurate or misleading. If the College decides not to amend the record as requested by the student, the\u00a0College will notify the student of the decision and advise the student of their right to a hearing regarding the request for\u00a0amendment. Additional information regarding the hearing procedures will be provided to the student when notified of the\u00a0right to a hearing.\u00a0\u00a0<\/span><\/li>\n
  3. The right to consent to disclosures of personally identifiable information contained in the student\u2019s education\u00a0records, except to the extent that FERPA authorizes disclosure without consent. One exception which permits disclosure\u00a0without consent is disclosure to school officials with legitimate educational interests. A school official is a person employed\u00a0 by the College in an administrative, supervisory, academic, research, or support staff position (including law enforcement\u00a0 unit personnel and health staff); a person or company with whom the College has contracted (such as an attorney, auditor, or\u00a0 collection agent); a person serving on the Board of Trustees; or a student serving on an official committee, such as a\u00a0 disciplinary or grievance committee, or assisting another school official in performing their tasks. A school official has a\u00a0legitimate educational interest if the official needs to review an education record in order to fulfill their professional\u00a0responsibility. Upon request, the College discloses education records without consent to officials of another school in which a\u00a0student seeks or intends to enroll. The following information related to a student is considered \u201cdirectory information\u201d and\u00a0 the College reserves the right to disclose it to anyone inquiring without the student\u2019s consent unless the student, within ten\u00a0 (10) days of registration each semester, informs the Office of the Registrar in writing on the proper form, available in the\u00a0 Office of the Registrar, that any or all such information about him\/her is not to be made public without his\/her written\u00a0 permission: The student\u2019s name, address, phone number, email address, photographs, date and place of birth, year in college,\u00a0 parents\u2019 names and addresses, prior educational institutions attended, dates of college attendance, degrees, scholarships,\u00a0 awards received, weight and height of members of athletic teams, participation in officially recognized activities and sports.\u00a0<\/span><\/li>\n
  4. The right to file a complaint with the U.S. Department of Education concerning alleged failures by St. Mary\u2019s\u00a0College of Maryland to comply with the requirements of FERPA:\u00a0<\/span><\/li>\n<\/ol>\n
